You could sell your own home...and if the agent in question does not have the necessary experience I respectfully suggest that you do so! You could hang a for sale sign on your property, place an advertisement in The Boston Globe, submit your listing to various websites including www.boston.com, www.craigslist.org, www.aol.com, www.msn.com, and now even post your property in your local MLS...then you can call all your neighbors, friends, relatives and business associates, dispatch mailings, host open houses, schedule individual showings, follow up with the prospects...negotiate with the buyer and or broker over price, dates, the P&S, disclosures, home inspection issues (or what I call the "buyer's remorse period of mourning"), deal with the mortgage company, the attorneys, appraisers, under writers and all the while making sure that the buyer is still in the deal?...etc., etc., etc! Some home owners may ultimately sell their own homes, but to be successful in this market the process usually requires the interaction of a professional
Realtor®" representing your interests as the real estate market is a "living and breathing" thing consisting of real people with different needs, wants, preferences, financing issues, time frames, and most importantly; opinions of value! However, it is quite evident based solely on the most recent Sales Data that Downtown Boston's property values dropped ±5-10% over the course of the past two years...the higher the price the higher the hit (statistics compiled from www.LINKBoston.com). Realistically, buyer's level of motivation and subsequent demand will most likely continue but ONLY for well-priced properties in all of Downtown Boston's Historic Neighborhoods!

However, I have been in the business long enough to know that an aggressively yet realistically priced property combined with a comprehensive Traditional Media & Internet-Based Marketing Strategy should be securely under agreement within the first ±30-60 days (as always, depending upon your time frame and preference), and then close within the next ±30-60 days. I try to price your property aggressively yet realistically with a plan that fits your time frame and preferences: so that it will sell quickly but at a price that doesn't "leave money on the table”. Until the spring market of 2005, provided that I marketed your home and followed through with a few brokers and buyers, your home would sell within days or a few weeks. Technology easily allows prospective buyers the ability to identify properties that are lingering on the market! Many times agents will intentionally over-price your home in an effort to 'buy your listing.' This is, without question, not in your best interest as an over priced property listing is a liability as statistics prove time and again that the best price is usually secured within the first few weeks of exposure to the general public. In my experience, if the interest level from the current buyer pool is low, nine out of ten times, the reason is that the market simply disagrees with the price. If a seller ignores this feedback -- or if a real estate agent does not discuss these issues with their client -- many times the risk of your property being labeled as "tired inventory" is inevitable! Allowing your property to sit on the market for too long will inevitably cost you time, added stress, and most of all money. Conversely, I respectfully suggest we acknowledge the reality of the market throughout the entire sales process whatever that may be, and then strategize accordingly in an attempt to consummate a financially successful and honorable transaction at the highest possible selling price!

I will also host future strategically scheduled open houses, but firmly believe that repeated open houses simply over expose a property creating a perception of desperation instead of a sense of confidence. However, if circumstances beyond our control, such as inclement weather, holidays, competition with other activities etc., affect the outcome, I will schedule another open house the next weekend available. If you wish, I will schedule a broker's preview a few days after the public open house. I will personally host all showings of your property as prospective buyers request any showings...the only true barometer of what the current market thinks of your property and the price!

Once you have an accepted and fully executed "Offer To Purchase Real Estate" the property is considered "Under Agreement". Please note that recent changes adopted by the MA Superior Judicial Court has determined that Offer to Purchase Real Estate Documents are Legally Binding provided that all contingencies have been satisfied. Customarily, the Purchase and Sale Agreement (commonly know as the P&S) is usually executed within the next fourteen (14) calendar days. The balance of the five to ten percent (5-10%) cash down payment is also customarily collected and submitted for deposit into the Seller's Real Estate Agency's Escrow Account (a personal check made payable to the listing agency is sufficient at this time). If this transaction is in conjunction with a 1031 tax-free exchange, please seek legal and/or tax advice ASAP! The Process
If you intend to be represented by legal counsel in your real estate transaction which is not mandatory but highly recommended, you might start by asking your current attorney for a recommendation if she/he does not practice real estate law. It also is a good idea to consult with your friends, relatives, neighbors and business associates for their legal counsel recommendations. However, the experiences of most of my clients have shown that it is usually best to hire an attorney who regularly practices real estate law and are familiar with the local real estate community.
I will be available to you and your attorney throughout the entire process and will coordinate the distribution and execution of the final Purchase and Sale Agreement and collection and deposit of the escrow funds. However, I truly believe that this is an opportunity for you and your legal counsel to discuss any and all of your concerns in regards to this transaction. You will be advised on many issues and will need to fully understand and agree to the final draft of the P&S. I strongly suggest that you read your entire P&S prior to execution. And by all means, if your P&S is not executed on time, I respectfully suggest that you or your attorney request a written extension from the buyer's counsel via facsimile.
